Conditions of Use

General

Unless otherwise indicated, product images serve as examples only and may vary from the delivered products. All details in the catalogue, newsletter and on the website are given without guarantee and are subject to errors.

Details on the size of plants are values for orientation. Minimal variation is possible.

We reserve the right to decline orders (without offering a reason) for economic reasons.

 

Conclusion of contract

By the use of the button -confirm order- the contract is concluded with ordering all products which are in your shopping cart.

Directly after sending your order, you will get an email with the confirmation of receipt of your order. The sale contract come about with our confirmation (email).

There is no sale to underage persons possible. The minimum age is 18 years.

 

Prices

All prices are in Euro including taxes (plants 13% VAT, fruits 10%, others 20%).

Additionally to the product price we calculate a sum for delivery. This delivery costs will be shown during ordering.

The delivery costs are dependent on the weight of products. The delivery costs of products which will be sent together in one package can be cheaper than single orders.

 

Delivery

All goods are generally dispatched on the next monday or tuesday after receiving payment. Large quantities by goods haulage or air freight. Where necessary delivery may be made in several consignments.

Delivery of plants is only possible into counries of the European Union.

 

Costs of delivery and packaging

The shipping charges are dependent on the country of destination and the weight of products.
Plants bigger than 120cm will be sent by goods haulage , costs of delivery after request.

Large quantities (more than 29kg) will be sent by goods haulage or where necessary delivery may be made in several consignments. Prices on request.

 

Delivery

All articles are generally dispatched until the next monday or tuesday after receiving of payment. 

In winter, during deep temperatures, delivery is not always savely possible. In this case we will wait with delivery until warmer temperatures.  We will inform you concerning the time of delivery.

A longer time of delivery or delivery on a specific date is possible on request.

 

Damaged, late or lost shipments

Shipping and importation are at your risk and expense. Costs incurred through import duties, inspection charges, treatments and the like are solely your responsibility. Damage to, or partial loss of shipments must be noted on receipt by the deliverer on the shipping documents.

 

Payment

Payment in advance by the use of paypal or money transfer. In Austria also delivery by cash on delivery is possible (please notice, that for the service cash on delivery 4,20 Euro will be calculated additionally to te delivery costs).

Pick up by the customer from our nursery in Guntramsdorf is on request possible.

 

Reservation of ownership

Goods remain in our ownership until full payment is made.

 

Data protection

We will only use your personal data for the completion and transaction of your order. Your personal data will definitely not be passed on to others, whith expection of the delivery service, which need name and adress data for product delivery and also when this is necessary for coordination of delivery time).

Your e-mail address will only be used for our email-newsletter, which is free of charge, if you have signed for it.

 

Right of cancellation

The right of cancellation does not apply for companies, legal persons under public law, and special assets under public law.

The right of cancellation does not apply for products, which were provided for customers specification.

You may cancel your contractual declaration within one week after formation of contract (day of ordering) without citing a reason. This cancellation should take the form of text (letter, e-mail to info@austropalm.at). The cancellation period begins with the day of ordering. In order to meet the requirements of the cancellation period, it is essential to inform us of your cancellation or return the goods in the correct time. Cancellations should be addressed to Austropalm.

 

Cancellation consequences

In case of effective cancellation, any contractual performance received by either party should be returned and any utilisation made remitted.

All transport costs in connection with returns are payable by the customer.

If you are wholly or partly unable to return the contractual product received to us, or where this is only possible in a deteriorated condition, then you will be liable to us for compensation to the extent of any lost value.

You have to fulfill your obligations for refunding payments withhin 30 days after declaration of your cancellation.
